These terms form the agreement between you and BRIGHTGENE PTE. LTD., a company registered in Singapore at 55 AYER RAJAH CRESCENT #01-26, Singapore 139949, for the use of this website and for genetic testing, ancestry analysis and related laboratory services. Please read them before ordering a kit or sending a sample.
By using the website or ordering a service you accept these terms. If you do not accept them, please do not order a service. Where you order on behalf of a clinic, research group or other organisation, you confirm that you are authorised to accept these terms for that organisation.
1. The Agreement
These terms, together with any written order confirmation and any additional conditions agreed with a clinic or institution, form the entire agreement between you and BRIGHTGENE PTE. LTD. for the services described on this website. No statement made in conversation, in a brochure or on a third party page changes these terms unless it is confirmed in writing by an authorised representative of the company.
Where these terms conflict with a signed agreement between the company and an institutional client, the signed agreement prevails for the services it covers. Where these terms conflict with a mandatory rule of law, the rule of law prevails and the remaining terms continue in force.
The company may use subcontracted laboratory or logistics providers, but it remains responsible to you for the delivery of the service under these terms.
2. Definitions
In these terms, service means any laboratory analysis, kit supply, report review or referral offered by the company. Kit means the collection device and packaging supplied for obtaining a sample. Sample means the biological material you provide. Report means the written result issued after analysis. Client means the person or organisation that orders a service.
Ordering clinician means a qualified healthcare professional who orders a test for a patient. Business day means a day other than a Saturday, Sunday or public holiday in Singapore. Writing includes email sent from an address the company has recorded for you.
A reference to company includes its staff, officers and authorised agents. A reference to you includes a person acting with your written authority.
3. Eligibility and Consent
You must be at least eighteen years old and legally able to enter a contract to order a service directly. If you are younger, an order must be placed by a parent, guardian or qualified clinician acting with proper authority.
Genetic testing requires informed consent. You confirm that you understand what the test examines, what it cannot establish, and how a result may affect you and your relatives. Consent for testing is recorded separately from consent for research and from consent for marketing, and declining the latter two has no effect on the service.
You may withdraw consent for further processing at any time by writing to support@brightgene.lat. Withdrawal does not require the company to destroy records it must keep by law, and it may end the service where the analysis cannot continue lawfully without consent.
4. Services We Provide
The company provides six service lines, each described on the services page. Ancestry Analysis compares typed markers against reference populations. Wellness Genetic Screening reviews common variants with published associations. Carrier Status Panels examine recessive conditions relevant to family planning. Sample Collection Kits supply the materials and return path for a sample. Laboratory Report Review provides a structured second read of a report and its underlying data. Genetic Counselling Referrals introduce a client to an independent counsellor when a finding calls for a conversation.
The scope of each order is fixed in the order confirmation. A service may be adjusted before analysis begins if the sample type or the quality of the material makes the requested assay unsuitable. In that case the company will explain the alternative and seek your agreement before proceeding.
The company does not provide emergency care, does not prescribe treatment and does not act as a substitute for a treating physician. Services are provided from Singapore and are subject to the regulatory framework that applies there.
5. Ordering and Intake
An order begins with an intake conversation or a written request. The company confirms the service, the sample type, the fee and an estimated turnaround before issuing a kit or accepting a sample. A message sent through the website contact form is an enquiry, not an order, until it is confirmed in writing.
The company may decline an order where the request falls outside its scope, where the consent record is incomplete, where the sample type is unsuitable, or where accepting the order would breach a legal or ethical obligation. A declined order that has been paid for is refunded in full apart from any courier cost already incurred.
Information you supply at intake must be accurate. A wrong date of birth, a mismatched name or an incorrect sample type can invalidate an analysis, and the company is not responsible for a delay caused by inaccurate intake information.
6. Collection Kits and Sample Handling
Kits are supplied with instructions and a return path. You are responsible for following the collection instructions, storing the kit as directed and returning the sample within the stated window. A sample that arrives degraded, leaking, unlabelled or outside its stability window may be rejected.
Title to the kit passes to you on delivery, but the kit remains subject to the company instructions for use. You must not resell a kit, alter its label or use it for a purpose other than the service it was issued for.
On arrival the laboratory performs an acceptance check and records the condition of the sample. Where a sample is rejected, the company will tell you why and may offer a replacement kit. A replacement may carry a reduced fee where the rejection was not caused by the company.
Residual sample material is retained for the period stated in the privacy policy and then destroyed. You may request earlier destruction in writing, understanding that a repeat analysis would then require a new sample.
7. Fees and Payment
Fees are quoted in the currency stated in the order confirmation and are payable before a kit is dispatched unless the company agrees otherwise in writing. Institutional clients may be invoiced under separately agreed terms.
A quoted fee covers the analysis described in the order. It does not cover courier charges from your location unless stated, referral fees charged by an independent counsellor, or any follow up test that you choose to order later. The company does not add a handling charge to a counsellor referral.
Where a repeat analysis is required because of a laboratory failure, the company performs the repeat at no additional fee. Where a repeat is required because of a sample problem or inaccurate information, a further fee may apply and will be quoted before work resumes.
Late payment of an invoice may attract interest at the rate stated on the invoice. The company may suspend work on an unpaid order after giving written notice.
8. Turnaround and Repeats
Turnaround estimates are given in business days from acceptance of a sample, not from the date of order. The estimate is an honest forecast rather than a guarantee, because a failed control lane or a quality flag can require a repeat before a report can be released.
When a repeat is needed, the company will inform you and give a revised estimate. If a delay extends beyond the revised estimate, you may ask for an update and, where the delay is materially longer than promised, you may cancel the order and receive a refund for the uncompleted work.
The company is not responsible for a delay caused by a courier, a postal service, a customs process or an event outside its reasonable control. It will however keep you informed and help trace a lost kit where possible.
9. Reports and Interpretation
A report is written for the person who ordered it. Where the order came from a clinician, the report is sent to that clinician, and it is for the clinician to explain the result to the patient. Where the order is direct, the report is written for a general reader and includes a plain language explanation of the finding.
Reports state the method, the limitations and the reference material used. Ancestry reports describe plausible origins as ranges and do not assert a single population. Wellness reports give effect sizes and do not present a variant as a diagnosis.
A report is issued in a signed, versioned form. If a later review shows that a correction is needed, the company issues a new version with a note explaining the change. The earlier version remains in the record. A report may not be altered by anyone outside the laboratory.
You may share a report with a clinician of your choice. You must not present an edited extract as if it were the full report, and you must not use a report to mislead another person about their own health.
10. Not a Medical Diagnosis
Genetic testing can inform a clinical decision but it does not replace one. A result describes probabilities and associations, and it must be read alongside a person history, examination and other tests. The company does not diagnose a condition, recommend a treatment or prescribe medication.
If a result suggests that clinical attention is needed, the report will say so and the company will offer a counselling referral. You should discuss any health decision with a qualified professional. Do not stop or change a prescribed treatment on the basis of a report from this laboratory.
In a medical emergency, contact local emergency services. The support desk at the company is not an emergency service and does not monitor messages outside business hours.
11. Client Responsibilities
You agree to provide accurate information, to follow collection instructions, to keep your kit and report secure, and to tell the company promptly if your contact details change. You agree not to send a sample that belongs to another person without that person giving informed consent in writing.
Where you order a carrier panel for a couple, each partner must give separate consent. Where you order for a family group, each adult participant must consent individually. The company will pause an order where consent appears to be missing.
You are responsible for any decision you make after receiving a report, and for seeking appropriate professional advice before acting on it. You are also responsible for keeping the report private if you do not wish it to be seen by others in your household.
12. Cancellation and Refunds
You may cancel an order before a kit is dispatched and receive a refund less any administrative cost that has already been incurred. Once a kit is dispatched, a cancellation may still be accepted before the sample is processed, subject to a deduction for kit and delivery costs.
Once analysis has begun, the fee is not refundable, because laboratory work and consumables have been committed. If the company cancels an order for its own reasons, you receive a refund for any work not performed.
A refund is normally issued to the original payment method within fourteen business days of agreement. A refund request should be sent in writing to support@brightgene.lat with the order reference.
13. Intellectual Property
The website, the visual system, the report templates, the laboratory procedures and the sample tracking software are owned by BRIGHTGENE PTE. LTD. or licensed to it. You may view and print a report issued to you for personal or clinical use, and you may share it with a clinician involved in your care.
You may not copy the website design, reproduce report templates for another provider, extract reference data for a competing service, or use the company name in a way that suggests endorsement without written permission. You may of course describe your own experience in your own words.
Any feedback you send about the service may be used by the company to improve its procedures, without any obligation to compensate you and without disclosing your identity.
14. Acceptable Website Use
You may use the website for lawful purposes connected with the services. You must not attempt to gain unauthorised access to any system, interfere with the availability of the site, submit malicious code, or use automated tools to copy large parts of the content.
The website is provided as a general description of the company and its services. It may contain errors or become unavailable during maintenance. The company will correct a material error when it is reported and does not accept liability for a decision made solely on the basis of a general description on the site.
Links to third party sites are provided for convenience. The company does not control those sites and is not responsible for their content or their privacy practices.
15. Privacy and Data Protection
The handling of personal data, including genetic data, is described in the privacy policy published on this website. The privacy policy forms part of these terms. Where the two documents differ on a question of data handling, the privacy policy prevails.
The company processes personal data in Singapore and may use a support provider located elsewhere, subject to the safeguards described in the privacy policy. By ordering a service you acknowledge that processing may occur in Singapore and in the locations of those support providers.
You may request access to your data, ask for a correction, or ask for deletion where no legal duty requires retention. Requests should be sent to support@brightgene.lat.
16. Limitation of Liability
Nothing in these terms excludes liability that cannot be excluded by law, including liability for fraud or for death or personal injury caused by negligence. Subject to that, the company limits its liability to the fee paid for the service that gave rise to the claim.
The company is not liable for indirect or consequential loss, for loss of profit or opportunity, or for a decision made in reliance on a report where the report was read outside its stated limitations. The company is not liable for a delay or loss caused by a courier, a postal service or a customs authority.
Where a sample is rejected because it was collected, stored or returned contrary to the instructions, the company is not liable for the resulting loss of the test. A replacement may be offered at the discretion of the company and on the terms described earlier.
Where the law of your country gives you a right that cannot be limited, this section applies only to the extent that the right allows.
17. Indemnity
You agree to indemnify the company against a claim, loss or cost that arises from your breach of these terms, from inaccurate information you supplied, or from a sample you sent without the consent of the person concerned.
This indemnity does not apply to the extent that the claim was caused by the company own act or omission, and it does not require you to cover a penalty that results from the company breach of law.
Where a claim is made, the company will notify you promptly and will allow you to participate in the response, provided that it retains control of its own defence and confidentiality obligations.
18. Force Majeure
The company is not liable for a failure or delay caused by an event beyond its reasonable control, including a natural disaster, an epidemic, a power failure, a network outage, a labour dispute, a change in law or a disruption to transport.
The company will notify you of the event and will resume the service as soon as it reasonably can. If the event continues for more than sixty days, either party may cancel the affected order and the company will refund any fee paid for work not performed.
19. Suspension and Termination
The company may suspend or end a service where these terms are breached, where a consent record is missing, where a legal or ethical obligation requires it, or where continuing would place staff or another client at risk.
Where a service is ended for a reason within the control of the company, a refund is issued for work not performed. Where it is ended because of a breach by the client, the company may retain the fee for work already done.
Sections dealing with intellectual property, liability, indemnity and governing law survive the end of the agreement.
20. Governing Law and Disputes
These terms are governed by the laws of Singapore. The parties will first attempt to resolve a dispute through good faith discussion, with a written notice describing the issue and the outcome sought.
If discussion does not resolve the matter within thirty days, the dispute may be referred to the courts of Singapore, which have exclusive jurisdiction, unless a mandatory rule of your local law gives you the right to bring a claim elsewhere.
Nothing in this section prevents either party from seeking urgent relief where a delay would cause serious harm.
21. Changes to These Terms
The company may update these terms when a service changes or when the law requires it. The effective date at the top of the page is revised with each update. A material change is announced on the homepage and, where an order is active, communicated directly.
A change applies to an order placed after the revised date. For an order already in progress, the terms in force when the order was confirmed continue to apply unless the change is required by law.
22. Contact
Questions about these terms, an order or a report should be sent to the address below. Please include the order reference and a summary of the matter so that the right team can respond.
